The Zoning Board of Appeals (ZBA) is established by Chapter 3.44 of the Village Code. It consists of seven Winnetka residents appointed by the Village President with the advice and consent of the Village Trustees. The Village President also designates one member of the Board to serve as chairperson. Members of the ZBA serve for terms of five years, which are staggered to assure the Board’s continuity.
Appointing Members
There are no other specific requirements for membership, although it has been the practice of Village Presidents to appoint members of the ZBA based on a demonstrated expertise, experience or interest in:
- Architectural history
- Architecture
- Building construction
- Engineering
- Finance
- Historic preservation
- Neighborhood organization
- Real estate
- Urban planning
Powers & Duties
- Conduct public hearings on all zoning variation requests and to prepare findings of fact based on the evidentiary record
- Make a final determination, for any variation request for which the Village Council has delegated the final decision-making authority to the ZBA, based on the evidentiary record, finding whether the applicable standards for zoning variations have been met or not, and granting or denying the variation
- And for variations for which the Village Council has retained the final decision-making authority, to make an advisory determination, based on the evidentiary record, finding whether the applicable standards for zoning variations have been met, recommending that the Council grant or deny the variation, and recommending what, if any, conditions the ZBA believes the Council should impose
- Conduct public hearings on all special use permit requests, including requests for planned developments, and to make an advisory determination, based on the evidentiary record, finding whether the applicable standards for special uses have been met, recommending that the Council grant or deny the special use, and recommending what, if any, conditions it believes the Council should impose
- Hear and make final decisions on administrative appeals from any Village Zoning Ordinance decision or interpretation
- Sit as the Building and Zoning Board of Appeals and, in that capacity, to hear and consider appeals from any order, requirement, decision or determination made by Village staff pertaining to building permit approval, building materials and methods, and the application of the model building, mechanical, dwelling and energy codes adopted by the Village
